Man Convicted a Second Time for 2005 Murder

District Attorney Don Quick announced today that Geraldo DelaCruz (dob: 08/03/1986) was found guilty for killing one man and seriously injuring another during a 2005 bar fight in Adams County, Colorado.

In the early morning hours of September 24, 2005, a fight broke out in the Mexico Lindo, a bar in Adams County. When security intervened, patrons ran out of the bar. Witnesses testified that DelaCruz had been in the fight. DelaCruz was seen leaving the bar where he then retrieved gun from his car and began shooting into a group of people outside the bar, killing Tomas Najera-Limon, and seriously injuring Jose Najera-Limon (dob: 08/22/1981). Evidence showed that Tomas was killed by a single shot that went through his left lung, heart and right lung, indicating that he was shot from the side while attempting to flee.

After a little more than an hour of deliberation, an Adams County jury found DelaCruz guilty of First Degree Murder (F1), Attempted First Degree Murder (F2), First Degree Assault Causing Serious Bodily Injury (F3) and Prohibited Use of a Deadly Firearm (M2).

DelaCruz was convicted for this crime by a jury in July 2007. However, in January 2010, the Colorado Court of Appeals reversed the conviction and remanded the case for a new trial.

Adams County District Court Judge Chris Melonakis immediately sentenced DelaCruz to life without parole at the Colorado Department of Corrections.
